The Issues of Implementation of the English Civil Procedure Institutions in the Russian Procedural Law System

The last decade is characterized by the tendency regarding the revision and reformation of European civil procedural law systems under the social, economic and political circumstances. It seems to be crucial to investigate different challenges that Russian procedural law system faces at this juncture. Several Russian legal institutions are in a sphere beyond the current juridical correction, therefore, it can be adapted to contemporary requirements by the analysis of modern legal orders. The main English civil procedure institutions of pre-court proceedings such as pre-action protocol, service of documents and declaration as to the veracity are selected for research in accordance with the actual stage of the current civil procedure reform in Russia. This choice is substantiated by the fact that the pre-court stage of the Russian civil procedure is one of the most obsolete and ineffective. Therefore, in the present project it is proposed that the implementation of English civil procedure institutions in the Russian legislation could result in improvement of the latter. Moreover, a number of methods of mentioned renovation are described. In conclusion, it is argued that the pre-trial stage of Russian civil procedure can be streamlined if legal provisions similar to English ones are implemented by the national legislator.
