Institute of representation in the civil process

Master thesis is devoted to the institute of representation in civil proceedings. In Russia, representation in civil proceedings has some problems that remain unresolved for a long time. This is also confirmed by many proposals for reforming and improving the institution. The author explores the theoretical side of the procedural representation: the concept of representation, types and the place of the institution of representation in the system of Russian law. In addition, the author explores the historical development of the institution of representation in civil proceedings and the foreign experience of regulation this institution. The author has revealed the characteristic features of the institute of representation in England, the USA and Germany. Having considered the institute of representation from the theoretical, historical and comparative legal side, the author draws attention to the existing problems in its legal regulation and analyzes proposals to solve them. The author comes to the conclusion that the qualitative reform of the institution of procedural representation is possible through the introduction of professional representation, which must meet all the criteria of professional activity.
