Vertical Arrangements as a Risk Factor for Domestic Companies

Vertical agreements are both a way to increase the efficiency of companies (for example, reducing transaction costs, risks of opportunistic behavior, etc.), and a source of risks associated with being accused of violating the requirements of the law on protection of competition. Accordingly, the work considers the sources of those and others and the practice of antitrust law enforcement in Russia. Taking into account the findings of the analysis, recommendations are made for companies on the use of vertical agreements from the standpoint of reducing the risk of accusations of violating competition law. The papper also identifies errors of FAS and the recommendations are made to eliminate them.
