Conciliation procedures in economic disputes in Russia

Conciliation procedures in economic disputes in Russia. The purpose of the master dissertation is to research the institute of conciliation procedures with their advantages and disadvantages and their place in arbitration process. The main objectives of the master dissertation are: a) determining the ratio of conciliation procedures and alternative dispute resolution; b) studying the main historical stages of the establishment of the institute of conciliation procedures in Russia; C) identifying the advantages and disadvantages of the main types of conciliation procedures in economic disputes in Russia; d) applying conciliation procedures at various stages of arbitration process. The following conclusions are made on the basis of the conducted research: firstly, disclosure the differences of alternative dispute resolution and conciliation procedures; secondly, the absence of a working and effective mechanism for filing of the pre-trial claim procedure; thirdly, in order to increase the attractiveness of the mediation procedure, the author has developed a new version of article 4 of the Federal law "On alternative dispute settlement procedure with the participation of an intermediary (mediation procedure)"; fourthly, it is determined that the primary task for legislator is increasing the level of business integrity and the formation of traditions of "good faith" as the foundation for development of institutions of conciliation procedures in Russia, what will reduce the burden on judges and improve the quality of justice.
