The Agreement of Participation in Shared Construction and Alternative Contracts

The present investigation is dedicated to the practical complex legal analysis of shared construction participation contract in the Russian Federation based on review of national legal instruments and law enforcement practice. The aim of the paper is to compare three types of contracts: shared construction participation agreement, presale contract and equity contribution agreement. The work contains legal safeguards and risks of each contract. Statutory penalty, compensation for moral injury, penalty on consumer protection law are analyzed as means of securing an obligation.
