Liability without Fault for Infringement of Intellectual Property Rights

This graduation thesis was prepared in the form of a legal memorandum based on the interpretation of rules of law and their practical application. The subject of this research is liability without fault for infringement of intellectual property rights. The assumed client raised the following questions for the study: 1) How did the civil legislation regarding liability for infringement of intellectual property rights develop? 2) How justified is the imposing of liability without fault for infringement of intellectual property rights in entrepreneurial activities performance? 3) How is liability without fault for infringement of intellectual property rights to certain intellectual property rights regulated? 4) What is the international experience of legislative regulation of liability without fault for infringement of intellectual property rights? The research includes four sections, each of which extensively examines the question raised by the assumed client to the author of the research, at the end of the research conclusions to which the author came following to the analysis of the issue are drawn.
