Legal Regulation of the Processing of Personal Data Without Data Subject`s Consent

The paper studies the problem of the legality of using publicly available personal data of users of the social network «VKontakte» for commercial purposes. As a result, the author made the following conclusions based on the analyzed provisions of the law and law enforcement practice. Personal data as information identifying a specific natural person may be processed without the consent of the data subject in the exceptions provided by law. These exceptions include the public availability of personal data, which may be related to user`s data from social networks. Publicly available personal data may be processed by third parties, in particular, for commercial purposes. However, a difficulty to the free processing and commercial usage of data are the principles of processing data on a fair and legal basis.
