Representations and Warranties as a New Method of Protection of Rights

This paper is devoted to examining representations and warranties as a new method for protecting civil rights. Our research objective is to analyse the development of the provision of Article 431.2 of the Civil Code of the Russian Federation concerning representations in the Russian laws, and the regulation of representations and warranties in English and American law. The structure hereof is governed by the aforementioned research objectives; it consists of the introduction, three chapters, the conclusion and the list of references, regulations, case law, as well as electronic sources to which we referred in the course of our work. The first chapter is dedicated to the history of this article and the main provisions of the Resolution No. 49 of the Plenum of the Supreme Court of the Russian Federation in which, inter alia, the issue of representations is addressed. The second chapter is concerned with the establishment of representations and warranties in English and American law. The third chapter dwells upon the established case law.
