The Concept and Content of the Legal Capacity of the Citizen

The relevance of the work is the study and General characteristics of the Institute of legal capacity of individuals, as it is a fundamental element of the civil status of the individual. The question of the emergence of legal capacity, at the moment, remains one of the most controversial. In carrying out the work, the author was given the following main tasks: to study the content and nature of legal capacity; to determine the ratio of legal capacity and subjective law; to understand the ratio of legal capacity and legal capacity; to study the question of the emergence of legal capacity, to identify the problems of legal capacity at the stage of conception of the subject of law; to study the issue of termination of legal capacity and determine what happens after the death of a citizen. Based on the results of the work the author formulated the main conclusions and recommendations. The methodological basis of the study was the method of structural and functional analysis and comparative law.
