The relevance of the chosen topic is determined by the fact that the legislation of the Russian Federation has gaps related to the liability of persons in situations where illegal write-offs of funds in the course of making payments on the Internet on the basis of passing the identification by a third party due to obtaining access to the mobile phone number of the owner of the electronic means of payment.

The aim of this work is to build a model of liability distribution among the entities involved in the process of making payments in electronic commerce, in cases of illegal write-offs of funds through the use of electronic means of payment when passing the identification by a third party as a result of obtaining access to the mobile phone number of the owner of the electronic means of payment.

To achieve the aim of the author's work, the following tasks were formed and implemented:

1. analysis of the legal nature of the term "electronic means of payment";

2. assessment of the degree of development of foreign legislation in respect of electronic means of payment in general, as well as in respect of liability of subjects of legal relations related to settlements in the Internet and based on the passing of identification;

3. research of the process and, in particular, the subjects of settlements with the use of bank payment cards and electronic money means in the sphere of electronic commerce in the Russian Federation;

4. consideration of relevant legal practices concerning unauthorized debiting of funds on the Internet;

5. modeling the mechanism for distributing responsibility for illegal write-offs of funds when using electronic means of payment in e-commerce in cases of identification by a third party due to obtaining access to the mobile phone number of the owner of the electronic means of payment.
