Legal Positions of the Constitutional Court of the Russian Federation: Legal Nature and Evolution

The graduate paper is aimed at considering the legal nature and the evolution of the legal positions of the Constitutional Court of the Russian Federation. The tasks of this paper are conduction of a comprehensive study of the category “The Legal Position of the Constitutional Court of the Russian Federation”; identification the characteristics of genesis and evolution, as well as highlight the forms of evolution of the legal positions. According to the results of the research there were marked two approaches to understanding of legal position: judicial and theoretical; formulated suggestions concerning with amendments to the legislation in terms of unifying the definition of "The Legal Position of the Constitutional Court of the Russian Federation"; elaborated definition of "Evolution of the Legal Position"; concretized and researched the forms of evolution of the legal position, such as additional interpretation, universalization, transformation; proposed classification of the legal positions, which is based on the forms of evolution of the legal positions.
