Annotation For the final scientific work on the topic: «Option in the Russian Civil Law». Author: Ryzhonin Rostislav Sergeyevich, student of group «МАД-171». Scientific work is includes: 69 pages. Scientific work is format practical. Keywords: option to enter into an agreement; option agreement; secondary rights, preliminary agreement, assigning the secondary right, gratuity option, fiduciary relations arising from an option, form of option. The subject of the research is the practical problems of applying the institution of an option in accordance with the general provisions of civil law. The purpose of the Scientific work - answers to practical questions that are not straightforward from the standpoint of current legislation and judicial practice. The key questions of the research article are as follows: the correlation of the option to enter into an agreement with an option agreement; the correlation of the option to enter into an agreement with preliminary agreement; correlation of the secondary rights with civil rights; the opportunity of assigning the secondary right for an acceptance for irrevocable offer for the third parties; the opportunity of applying the provisions of paragraph 1 of the Chapter 24 of the Civil Code of Russian Federation to such assign by using the analogy of the law; fiduciary relations that prevent the assignment of secondary rights; the problem of assegnment of debt in the case of the assignment of a secondary right to accept an irrevocable offer submitted for the execution of a commutative contract; the correlation of the voluntary option for the execution of the agreement with deed of gift; the form of the purchase agreement in case of granting an option for its execution.
