Limits and Restrictions of the Carrier's Liability in Russian Civil Law

This final qualifying paper is devoted to the analysis of practical issues in the sphere of limitation of carrier’s liability in Russian civil law. The author models and studies various problematic practical issues, gives an answer to them taking into account the existing legal regulation and judicial practice. The urgency of the WRC is due to the large number of situations that arise in practice, the resolution of which is not always obvious from current legislation and law enforcement practice. The purpose of the Final Qualification Work is to formulate a legal position and final conclusions de lege lata on the questions posed by the author. In this paper, the author has reviewed five problematic issues that are potentially possible in the sphere of transport obligation, affecting the institution of limiting carrier’s liability, presents various doctrinal positions on this issue, analyzes judicial practice.
