Features of the Legal Regulation of the Trademark in the Field of Sports

Final qualifying work "Features of the legal regulation of a trademark in the field of sports" contains 76 pages of text. The object of the research is social relations related to the use, disposal and protection of the right to a trademark in the field of sports. The goal of the study is to form a comprehensive understanding of the features of the use, disposal and protection of the right to a trademark in the field of sports. To achieve this goal, the author sets the following tasks: - To form an idea of the development of the legal Institute of the trademark in the field of sports; - To establish the features of legal and corporate acts regulating trademarks in the field of sports; - Analyze court practice related to the registration, use and protection of trademarks in the field of sports; The empirical base of the research is the practice of application of legal acts regulating the use and disposal of the exclusive right to a trademark in the field of sports and its protection. The work consists of an introduction, three chapters comprising nine paragraphs, and a conclusion. The first Chapter describes the General characteristics of a trademark as a legal institution, including the concept, features, content of the exclusive right to a trademark, functions and types of trademarks. In the second Chapter the levels of legal regulation of a trademark are investigated, and also features of corporate regulation of a trademark in the sphere of sports are revealed. The third Chapter is devoted to the registration and protection of the right to a trademark in the field of sports. Responsibility for illegal use of trademarks in the sphere of sports is specified, separate disputes connected with protection of the rights to trademarks in the sphere of sports are investigated. In conclusion, the paper contains a summary of the findings of the study, which served as the basis for the formation of provisions for the defense.
