Interaction Between State Arbitrazh Courts and Arbitration Tribunals

The purpose of the study was to investigate the institute of interaction between the state arbitrazh court and arbitration tribunal. The results clearly show that this institute works effectively. The main reason for addressing the institute is the unjust decision of arbitration tribunal. Parties refer to this institute when one of them fails to comply with the decision. As a result, this institute performs function of control over the procedure in arbitration tribunal. However, the institute does not work if parties write in the contract that the decision of arbitration tribunal is final. Despite the fact that the arbitral tribunal does not consider the merits, this institution acts as an effective way to protect and help the parties to resolve the conflict.
