Protection of Intellectual Rights under the Legislation of the Russian Federation

The paper presented is devoted to the research of mechanisms and peculiarities of intellectual right defence. By the way of analysis the legislative and doctrinal sources, the author distinguishes the nature of intellectual rights and disputable kinds of intellectual property. The research uncovers the features of forms and ways of such right protection and their most effective application fields. Moreover, the differences between the ways of exclusive and incorporeal right defence and bound law enforcement problems are particularized with the help of jurisdiction. Further, the author brings to light existing lawful gaps that appear while people are brought to administrative and criminal justice in the intellectual property area.
