Legal Status of International Providers Of Information Transmission

The master’s thesis represents a comprehensive analysis of the international treaties, the legislation of the Russian Federation, the European Union and the United States, legal doctrine and relevant judicial practice on the sharp issues concerning regulation the activities of international organizers of information transfer (dissemination) in the Internet (hereinafter – «the Organizers»). The author reviews the aspects of the Organizers’ legal nature and the main issues they face in their activities at the international level. The key focus of the master's thesis is made on the implementation of the Organizers’ rights to free receipt and transfer of information, as well as on the basic freedoms of speech, opinion and media. The author arrives at a conclusion that modern rules of private international law and Russian law do not correspond to the dynamics of the development of a virtual network, which leads to a number of legal problems. In order to prevent such problems and to avoid their repetition in the future, several reforms aiming to achieve a balance between information security and freedom of speech shall be adopted at the international level. Meanwhile, Russian legislation is required to be globally changed for the purpose of reducing the development gap to private international law and the national law of the other jurisdictions (The European Union, the USA).
