Problems of Evidence in Cases Involved With Organization of Criminal Community

The final qualification work is devoted to the problems of proof in cases related to the organization of the criminal community. The purpose of the study was to analyze the problems that arise in the process of proving and qualifying cases related to the organization of a criminal community. To achieve these goals, tasks were set to identify and characterize the objective and subjective signs of the crime in question, to delimit it from related elements and to identify mistakes made in the investigation and qualification of acts that fall under the signs of organizing a criminal community or participating in it. As a result of the study, the concept of a criminal community, its organization and participation in it is given, objective and subjective signs of the composition of this crime are investigated and indicated, differences from banditry, organization of an illegal armed formation or participation in it, robbery are identified, qualification errors are identified, through the consideration of cases judicial and investigative practice.
