Constitutional Complaint: the Issue of Legal Capacity in Constitutional Proceedings

The institution of a constitutional complaint is important not only in the Russian Federation, but also in other countries. 122,812 applicants appealed to the Constitutional Court of the Russian Federation over the past 7 years. However, the right to appeal to the constitutional court has a defect and requires modernization. This research is about the issues of determining the subjects of the right to appeal with a constitutional complaint, their constitutional procedural legal capacity. The author offers several legislative initiatives to overcome identified legislative defects and ensure citizens' access to constitutional justice.
