Legal Arrangements of Providing the Right of Light and View

In the graduate qualification work student considered the problem of legal providing the right of light and view. In particular, during the research of current legislation student concluded that the right of light and view are secured in the Russian Federation only in the public legal regulation, private law institutions do not directly regulate it. The existing regulation was found to be insufficient, as it do not provide the concerned person with adequate legal protection when his or her legitimate interest is violated. Student considered the expediency of solving the existing legal problem by establishing the servitude of light and view. The graduate qualification work presupposes the analysis of the prospect of fixing such kind of servitude in the framework of the current Russian civil legislation. Also, student assessed the possibility of providing the right of light and view by establishing an obligatory legal relationship between two owners of neighboring real estate objects, identified risks and disadvantages of such a way to provide the right of light and view.
