Autonomous Runet in the Right to Access Information Context

The paper examines the problem of the free access to information on the Internet in connection with the adoption of the «Autonomous Runet» Law. The author identifies shortcomings in the existing legal regulation, as well as the presence of measures that excessively restrict the free access of citizens to information. This work is aimed at a comprehensive study of the existing problem from the theorical and practical point of view and at developing a draft of changes to legislation. In the course of the research the author studied domestic and foreign scientific literature, the existing regulatory framework and judicial practice. In particular, legal positions of the Constitutional Court of the Russian Federation and the European court of human rights were also analyzed. During the analysis of the legal regulation of access to information on the Internet, the motives of the legislator were determined, as well as the positive and negative sides of the «Autonomous Runet» Law were considered. The author concluded that the existing regulation may show its positive aspects in future, but the negative aspects significantly exceed the positive ones. The result of the study was a draft of amendments to the Federal Law «On communication» , which reflected the main ideas of this work.
