An entrepreneur spends a lot of money on developing his brand, in particular, registering his trademark, which allows to individualize a promoted product or service in the market. Moreover, the procedure for registering a trademark is not simple and requires a lot of time and material investment from the copyright holder. At the same time, the use of a trademark by unscrupulous entrepreneurs can bring not only financial losses, but also cause serious damage to the reputation. That is why it is so important to protect a trademark from unfair use, but given the features of the Internet, this presents some difficulties. The aim of this work is to propose improving existing legislation in the field of legal regulation of a trademark based on an analysis of prevailing judicial practice, suggest ways to solve problems related to protecting the Internet trademark, and also suggest ways to protect the trademark from illegal use by business entities on the Internet.
