Intellectual Property Issues Management in Cases of Joint Venture Party`S Withdrawal

The problems associated with creation and managing international joint ventures are stablished in domestic and foreign literature. However, the problems of structuring agreements during creation of joint ventures still do not have a solution in the sphere of intangible assets in case of termination of partnerships. The creation of joint ventures with the aim of developing and using unique technologies is one of the most common international forms of doing business, thus, it is important to define the legal consequences of the termination of the joint venture. The purpose of this work is to offer ways of adapting the issues of intellectual property ownership to the corporate conditions of the agreement on the creation of a joint venture in order to prevent further conflicts. In this work also analyzes the provisions of the current legislation to determine who will be the owner of the intangible asset in the absence of preliminary agreements of partners, whether it is possible for the former partners to co-own individual intellectual property rights.
