Zones With Specific Terms of Use: Legal and Practical Problems of the Application of the New Legislation

The goal of the thesis on the issue: «Zones With Specific Terms of Use: Legal and Practical Problems of the Application of the New Legislation» was to evaluate the effectiveness of the new legislation of zones with specific terms of use (further - ZSTU) in protection of the private property owners` rights on the territory of ZSTU. The research was carried out by studying land and urban planning legislation, and the scientific literature. This work contains a comparative analysis of the judicial practice that took place before and after the introduction of the new legislation of ZSTU. The research ended up in the proposals on the interpretation of the current compensation of loss legislation. The practical value of this paper is to protect the bona fide owners of the land who according to the current interpretation of the new legislation appear to be unable to recover their losses due to the establishment of ZSTU.
