The Legal Issues in a License Agreement Regulation

This research is aimed at identifying, posing and resolving both theoretical and practical problems associated with the institution of a license agreement. In particular, the possibility was established of applying rental standards to relations from a license agreement; the problem of "parallel licensing" is indicated; features of the legal nature of an open license agreement are defined in comparison with other civil law institutions; the possibility of applying Creative Commons licenses based on the principle of freedom of contract has been established; identified the need to determine the order governing copyright disclaimer, proposed amendments to the law; the dual nature of compulsory licenses and the problems of legal regulation regarding the conditions and liability under a compulsory license are determined; the problem of establishing criteria for determining the importance of technical achievement and economic benefits of the invention.
