Compensation of Harm as a Result of the Publication of an Illegal Normative Legal Act

In the present work the issue of non-contractual liability of the state for the damage caused by the publication of an illegal normative legal act has been studied. The analysis of historical material about the state's tort obligations since the 1864 Judicial Charters up to the present time is carried out. The attempt of substantiation of the claim presentation on the basis of articles 16 and 1069 of the Civil code of the Russian Federation to court of citizens and the organizations on compensation of damage as a result of the edition of the illegal legal act without preliminary contest of the legal act in an order of chapter 21 of the Code of administrative legal proceedings of the Russian Federation is made.
