The paper is dedicated to analysis of the case law of the courts of general jurisdiction regarding Article 20.2 of the Administrative Offences Code of the Russian Federation within the framework of the case law of the Russian Constitutional Court and the European Court of Human Rights. The paper consists of three chapters: Chapter 1 covers the case law of the European Court of Human Rights, Chapter 2 covers the case law of the Russian Constitutional Court, while in Chapter 3 the case law of the St Petersburg courts of general jurisdiction from 2018 is analysed. The paper proves that case law of the Russian courts of general jurisdiction does not always meet the requirements of the highest courts and suggests how this problem can be solved.
