The Concept of "Horizontal (Floor) Ownership" in the Legal Sense of Common Property in an Apartment Building

The work is devoted to the search and the real way of legislative consolidation of an acceptable analogue of the Russian concept of horizontal (floor) ownership in order to replace the last one in the Russian law, due to both unjustifiably underestimating the value of the ownership of the common property of an apartment building and the difficulty of transferring the model of a single-based property object in the Russian law. The paper analyzes the models of legal regulation of the property in the context of finding the necessary basis for securing such an analogue, as well as the construction of horizontal (floor) property both in Russia and in selected western countries, on the basis of which a classification of such structures is formed. The author concludes that it is necessary, firstly, to change the horizontal (floor) ownership by the type of non-authentic floor ownership implemented in Switzerland and, secondly, its operation simultaneously with the construction of horizontal (floor) ownership already established in the Russian law.
