The Entity as a Subject of Crime. Substantiation of the Necessity and Implementation of the Reform

The number of economic crimes with entities is growing steadily. Some Western European countries created an absolutely new institute – the institute of criminal responsibility for entity. Although this field is only 20 years old, the entity as a subject of the crime becomes a wildly discussed precedent. First of all, there is a huge difference between approaches to the nature of the entity. Secondly, practicing lawyers do not understand company’s procedural role. This paper proves the importance of this institute and justifies the need for its introduction in Russia. Our analysis is based on court data that covers the cases where entity was an accused. As a result, we conduct a possible rationale for the findings and some related law remedies. For the future, our results could be possibly used by Russian lawmakers to avoid mistakes of European colleague.
