Parallel Imports in the EU Private International Law

This final qualification work is devoted to parallel imports in the international private law of the European Union. The work consists of three chapters, divided into 6 sections. The introduction justifies the relevance, defines the object and subject, goals and objectives, research methods, as well as the theoretical basis and practical establishment of this final work. The first chapter, “Theoretical and Practical Foundations of the Concept of Parallel Import,” which includes two paragraphs, contains and reveals the theoretical aspects of the principle of exhaustion of rights, and the concept and reasons for parallel import. The second chapter, “The history of parallel imports in the European Union”, consists of two paragraphs as well. The first is aimed at analyzing the development of legal norms governing the turnover of products of copyright holders within the EU. Whereas the second paragraph explores the relationship of the introduced legal norms along with judicial practice. The third chapter, “Legal Regulation of the Subjects of Relations in the Digital Age,” consists of two sections, and sets the goal of creating a model for legal regulation of parallel imports. This model strives to compare the interests of parallel imports in the context of the digital environment. In conclusion, the author summarizes all accomplishments and draws conclusions on the implementation of the goals. Based on the results of the final work, the author offers a model of legal regulation of parallel imports, which will respond to modern conditions of all parties related and subject to interactions.
