Features of the Employment Contract with Medical Workers

The labor relations in the healthcare system of the Russian Federation are complicated by the legal status of medical workers and the presence in their legal status of a set of responsibilities that go beyond the scope of labor law. The presented work involves the study of the norms of both labor and medical law. The main purpose of this paper is to identify the features of the employment contract with medical workers of the budgetary organizations of the Russian Federation. The following objectives are set or its accomplishment. First, to study of legal acts regulating the work of the medical workers. Secondly, to identify the specifics of the content of the employment contract with the medical workers. Thirdly, to reveal the specifics of concluding, changing, and terminating the employment contract with the medical workers. Finally, to consider problematic issues in the practice of applying regulations on the regulation of labor of medical workers and determine the possible ways of modification of the labor legislation of the Russian Federation. The paper is divided into two main parts, besides Introduction, Conclusion, and the List of references. The introduction describes the relevance of the research topic, its goals, objectives, subject and object of the research. In Chapter One the normative legal acts regulating labor relations of the medical workers and the issues of the concept of an employment contract and its content, the elements of an employment contract with medical workers, and the parties to an employment contract with the medical workers are researched. Chapter Two is concentrated on conclusion of an employment contract with the medical workers, changing the terms of the employment contract with medical workers, and termination of the employment contract. In conclusion, brief conclusions on the topic are presented. During the work, it was revealed that the legal regulation of the employment contract with the medical workers is insufficiently developed, namely, it needs the addition of norms and a publication of the new legal acts. Without these necessary changes it is extremely difficult to achieve the availability of the modern medical care and improving its quality in the Russian Federation. In particular, the employment contract with medical workers must contain additional provisions on the labor function of the medical worker, an article indicating the obligation to observe medical secrecy, and a condition for mandatory annual improvement of professional knowledge in the additional educational programs and mandatory insurance of professional liability of medical workers. In work, as a way to improve the regulation of labor relations with medical workers, it is proposed to introduce a new Chapter in the Labor code of the Russian Federation called ‘Features of legal regulation of labor of the medical workers’.
