Representation in Commercial Proceedings

The relevance of the topic of representation in the arbitration process is associated with reforms that have been actively taking place in the Russian legal system since 2017. One of the significant changes in the Arbitration Procedure Code of the Russian Federation is the new version of Article 59, part 3, which now states that a representative can only be a person with a higher legal education or academic degree in law, except for some cases specified in the code. Thus, a requirement for educational qualification for representatives have been introduced into the arbitration process. The aim of the study is a comprehensive review of the institution of representation in the arbitration process: the study of regulations, theoretical provisions, the study of the reform of the institution of representation and the perspective for its further development. In the first chapter the author examined the history of representation in the arbitration process of the Russian Federation, the concepts and types of representation. In the second chapter the subjective composition of the representative office, registration and confirmation of authority of the representative, as well as the possible rights of such a person were analyzed by the author of the thesis.
