Special Procedure of Trial in Criminal Proceedings

The final qualification paper presents a study on "Special Procedure of Trial in Criminal Proceedings".The purpose of the study is to study the theoretical provisions justifying the need for simplified forms of court proceedings in the form of a special procedure for resolving criminal cases, to analyze court practice for conducting statistics, to study the main problems and develop proposals for their elimination. The subject of the study is the provisions of Russian Federation legislation, criminal procedure doctrine, legal theory, as well as the totality of criminal procedure rules governing special procedures in criminal proceedings, the materials of judicial practice in the area of resolving criminal cases with the consent of the accused with the charges against him. The research is based on scientific works of process scientists of the Soviet and modern period, as a regulatory framework were the provisions of federal laws and international acts in in the criminal justice system. As an empirical basis for the study are materials from court practice in criminal cases, statistical reports from the departments of the Judicial Department of the Supreme Court of the Russian Federation for the period 2015-2019 and materials from court practice. This graduation work consists of an introduction, two chapters, a conclusion, a list of sources used. The introduction of the work describes the relevance of the topic, fixes the provisions on the purpose and objectives of the research, raises the issue of the subject, object and methods of research, defines theoretical foundations, empirical basis, as well as scientific novelty and own view of the research. Chapter 1 deals with the emergence of special procedures in criminal proceedings, historical background and aspects, and comparative analysis with foreign legislation. Chapter 2 describes the legal nature of the special procedure of court proceedings if a person agrees with the charge against him/her (Chapter 40 of the Russian Federation Code of Criminal Procedure), the analysis of court practice, confirmation or disproof of the effectiveness of this institution.
