Summary Proceedings in Civil Procedure in Russia and EU Member States: a Comparative Study

This work is dedicated to a comparative study of summary proceedings in Russia and the EU Member States. The purpose of the research is to identify advantages and disadvantages of summary proceedings regulation in the aforementioned jurisdictions and to determine whether it is possible to use practices of one legal system to perfect the legislation of the other. Within the research, legal regulations and enforcement practices related to summary proceedings were studied, legislative lacunas were identified and suggestions for improvement of civil procedure in Russia and on a supranational level were presented. The work consists of three parts. The first part entails prerequisites for the emergence of summary proceedings in Russia, provides a general description of the proceedings and outlines a comparative analysis of summary proceedings in civil and arbitrazh procedure. The second part includes information on the history of development of common European summary proceedings as well as general descriptions of the European Small Claims Procedure and the European Order for Payment procedure. The third part is dedicated to the comparative study of summary proceedings in Russia and EU itself and to the suggestions for implementation of some EU practices into the Russian civil procedure and into the Eurasian Economic Union.
