Alternative Dispute Resolution: the Process of Establishing the Mediation Institution in Russia

Mediation is a relatively uncommon legal institution in Russian society. The aim of this work is to study the institution of mediation, to provide a comprehensive description of the theoretical foundations and characteristics of the concept of mediation, to identify ways to optimize and improve the legal application of mediation procedures, as well as trying to discover ways to popularize the mediation procedure in the society. The research is divided into three main parts. The first chapter defines the general concept of conciliation procedures in Russian law and their distinctive features. The second chapter is devoted to the definition of the concept of mediation procedure, its principles and basic characteristics, the practice of the application of the Law on Mediation by the courts, as well as the identification of problems of integrating mediation procedures into the Russian legal culture and the development prospects of this legal institution. Chapter Three is concentrated on the comparative legal analysis of the institution of mediation in Russia and foreign countries. In the end of the research there are main conclusions based on the results of the study.
