Judicial Discretion in Criminal Law

The final qualifying work consists of an introduction, the main part-2 chapters, combining 4 paragraphs-conclusion and bibliography. The introduction reveals the relevance of the chosen topic, defines the scientific problem, object, subject, goals, tasks and methods of research. The object of this research is judicial discretion as a phenomenon of criminal law of the Russian Federation. The subject of the study is the relationship that appears in connection with the variety of judicial discretion, related to both the subjective factor and the broad possibilities of the court in applying the letter of the law. The first Chapter sets out General provisions concerning judicial discretion in criminal law. It presents the existing approaches to defining the concept of judicial discretion in legal science, formulated its own definition of this concept, and disclosed its main features and limits. The second Chapter provides an example of various decisions of the courts of first and second instance, which clearly Express judicial discretion, and also examines the different approaches of foreign countries in relation to the establishment of the limits of the institution of judicial discretion. The conclusion summarizes the work done and formulates conclusions and suggestions on the scientific problems identified during the study of the topic "judicial discretion in criminal law".
