Indirect Claims in the Arbitration Process of Russia

This final qualification work is devoted to the study of the institution of indirect claims in the arbitration law of Russia. As a methodological base for this work, the scientific works of domestic and foreign scientists in the field of substantive and procedural law and the regulatory legal acts of the Russian Federation and other countries were used. The relevance of the work is justified by legislative reforms in the field of regulation of the institution of an indirect claim, and the need to study issues of its enforcement. The aim of the work is to determine the nature, concept and mechanism of an indirect claim in the arbitration process of Russia. To achieve this goal, the following tasks were completed: to study domestic and foreign literature on this issue; to identify historical ways to protect corporate rights and the evolution of the institution of an indirect claim; to define the concept of an indirect claim and the procedural position of the parties in cases related to indirect claims; to study the mechanism of work of the institute of an indirect claim in foreign countries and in Russia. This work consists of an introduction, two chapters, eight paragraphs, a conclusion and a bibliography. Based on the results of the work, the following conclusions are drawn: at the present moment, the concept of an indirect claim requires a normative definition, there is a need to develop a procedural procedure for considering cases of indirect claims.
