Arbitrability of Corporate Disputes

This paper discusses issues of the arbitrability of corporate disputes, mainly in the Russian Federation, also describes the practice of foreign legal systems on the arbitrability of this category of disputes. The development of arbitration in the Russian Federation has recently been associated with a wide reform of the legislation on arbitration, in the framework of which a new law regulating the issues of internal arbitration was adopted, as well as amendments to certain legislative acts containing the regulation of arbitration in the Russian Federation were introduced. In this regard, we believe that it is necessary to conduct an initial analysis of judicial practice in order to identify the susceptibility of judicial practice to the new rules on arbitration, as well as to determine whether there are changes in attitudes towards arbitration. In the framework of this study, we will consider the main problems associated with arbitration in the Russian Federation, which include problems such as the definition of a clear range of disputes that are not arbitrable, as well as the establishment of specific positions regarding the public policy clause in relation to the consideration of issues of corporate arbitration .
