Consolidation of Claims and Proceedings in International Commercial Arbitration

This work explores different approaches to the institution of consolidation in international commercial arbitration. The paper analyzes arbitration rules of various arbitration institutions to identify the specifics of implementation and use of this procedural instrument. A proper understanding of the rules will allow parties to disputes to avoid additional costs, as well as to achieve efficiency in resolving disputes from homogeneous legal relations and multiple contracts. The main objectives of the study are to compare and analyze different approaches to consolidation in various arbitration institutions, the position of state courts in different jurisdictions regarding consolidation in different cases, as well as recognition and enforcement of decisions in consolidated arbitration proceedings. In addition, another objective is to study one of the newest institutions in international commercial arbitration of inter-institutional consolidation - the possibility of combining processes from one legal relationship with different arbitration clauses in different arbitration institutions. This work contributes to the promotion of arbitration as an alternative method of dispute resolution.
