International Notary Law: Main Problems and Perspectives of Development

Current research work involves problems and perspectives for the development of international notary law. In cross-border legal relations, the role of the notary is quite significant, especially in matters related to the protection of inheritance rights, real estate rights, family relations, as well as accompanying various transactions between foreign counterparties and ensuring the fulfillment of obligations between the parties. This work involves the study of theoretical and practical aspects, a comparison of various notarial systems, identifying the features of individual notarial acts. The main purpose of study is to analyze problems arising in the process of performing notarial actions with a foreign element, such as choosing of applicable law and recognition of documentation, determining the prospects for the development of international notarial systems, including analysis of international organizations such as International Union of Latin Notaries. The relevance of the study is confirmed by increasing the complexity of cross-border legislation in the field of international notaries and increase of appeals by citizens and organizations to notaries regarding issues of foreign inheritance, division of property, cross-border marriages and other cases. The international notary law is regarded as a progressive institution applying modern technological solutions. The study seems to be a starting point for more narrowly focused work on this topic for both students, lawyers and notaries.
