Joint Will of Spouses: its Regulation in Russian and Foreign Law

On June 1, 2019, provisions came into force that introduced revolutionary institutions for joint inheritance of spouses and inheritance agreement for domestic inheritance law. This work will be devoted to one of the short stories in Russian inheritance law - the joint testament of spouses, which enables citizens of a registered marriage to dispose of both personal and common property jointly. When implementing the institution of joint testament of spouses in Russian inheritance law, the legislator was based on the experience of many foreign legal orders, since this institution has long been known in world practice and is used in Germany, Great Britain, the USA, Ukraine, Latvia and many other countries. However, the institution of the joint testament of spouses was ambiguous in Russian legal literature, due to the abundance of problems, among which the most discussed are the uncertainty of legal nature and the lack of ways to protect against abuse. In this regard, in the final qualification work, an analysis of the institution of the joint testament of spouses in Russian and foreign law is carried out.
