Order for Payment Procedure as a Form of Court Procedure: Problems and Development Prospects

Nowadays, one of the fundamental directions of the development of procedural legislation in Russia is recognized as increasing the availability of justice, improving its form, as well as simplifying judicial procedures that allow resolving insignificant or typical cases (for example, to recover a debt) bypassing the “classic” claim proceedings. Firstly, these directions are considered in civil proceedings due to the steady increase in the number of cases. The improvement of the simplified procedure system allows not only to reduce the burden on the courts but ensure effective protection of violated rights and legitimate interests of an individual or legal entity as well. In other words, it contributes to strengthening the foundations of civil society in the Russian Federation in general. Secondly, in order for the mechanism of judicial protection of violated rights to work more effectively, the procedural form is being improved by introducing new procedural rules that take into account the material and legal features of cases considered in civil proceedings to the greatest extent. This research is devoted to the analysis of order for payment procedure in civil proceedings, as one of the forms of simplification of legal proceedings.
