Comparative Analysis of Jury Trials in Russia and the USA

This research is devoted to a comparative legal analysis of the institution of jury trials in the Russian Federation and the United States of America. The institute of jury trials has recently become a subject of discussion for Russian lawyers. Meanwhile, the question of the need for a jury in the judicial system raises many controversial issues, as well as the issue of imposing the death penalty or introducing the right to euthanasia. In this connection, it seems relevant to understand what the significance of the institution of the jury is, what its model is used by Russia and what the future of the jury in our country is. The object of this study is public relations related to legal regulation, organization and activities of the jury trial institute in the Russian Federation and the United States of America. The subject of the study is the criminal procedural rules of the Russian Federation and the United States of America, which regulate the activities of the institute of jury trials. The purpose of this work is to identify the distinctive features of trials with jurors in criminal trials of the Russian Federation and the United States of America, as well as the development of recommendations for improving the current legislation of the Russian Federation. To achieve the above goals, it is necessary to solve the following tasks: 1. To analyze and compare the criminal procedural legislation of the Russian Federation and the United States of America on all aspects of jury trials, including the process of selecting candidates and the trial itself; 2. To study the history of development and modern practice of the institute in the Russian Federation and the United States of America; 3. Investigate the goals, objectives and principles of the jury; 4. To analyze the judicial practice of using jury trials in the Russian Federation and the United States of America; 5. To identify current problems of the application of jury trials in Russia and the USA; 6. Identify areas for improvement of Russian legislation on court matters with the participation of jurors.
