Taxation of Securities Transactions

The question of possibility of implementation of foreign experience of legal regulation of taxation of operations with securities (property taxation) in the tax system of Russia is considered in research work, thus, in the course of research of essence of the Russian legal regulation of operations with securities deficiencies of theoretical and practical aspects are revealed in the same time. The author analyses the historical factor in development of legal regulation of taxation of operations with securities, researches the basic concepts used in tax legislation, gives an estimation of realization of some legal principles, reveals legal features of definition of tax base on incomes of physical and legal persons from operations with securities. Also, foreign experience in legal regulation of taxation of transactions with securities is studied by the example of the USA, UK, France and Italy, relevance of such experience for legal regulation in the Russian Federation is analyzed. Completing the research, the author concludes that it is impossible to introduce such a tax in Russia in the near future for a number of economic, legal and social reasons.
