Interim Measures in International Investment Arbitration

Abstract to the master dissertation on topic “Interim Measures in International Investment Arbitration" The dissertation is devoted to the analysis of theoretical, regulatory and practical foundations of the interim measures in international investment arbitration. The author considers, firstly, the legal nature of interim measures in international investment arbitration and, secondly, the types of such measures and conditions of their application. As a result of the study of accumulated practical and theoretical material, the author concludes that, despite the existing gaps and uncertainties in the regulation of interim measures applied in international investment disputes, the litigation and arbitration practice has developed a consistent and unambiguous approach to the application of such measures. At the same time, the paper proposes to address regulatory gaps by providing a clear definition of interim measures specifically for international investment disputes in an international treaty, defining minimum and universal criteria for the application of such measures, as well as a clear rule on the competence of arbitrators to apply the interim measures considered in this paper.
