Managing Organizations in the Housing Sector: Problems of Creation and Activity

The relevance of the chosen topic is that the norms of housing legislation on the creation and activities of management organizations in the field of housing and communal services are not perfect, since management organizations, as a subject of legal relations in the field of housing and communal services, appeared relatively recently. These norms do not have a uniform application of the current legislation, they are interpreted in two ways, and in practice there are often problems with gaps in legislation, including due to insufficient theoretical development of issues and problems in this area. As a result of the research, it can be concluded that the norms regulating legal relations on the creation and operation of management organizations are not effective, are scattered, and are fixed in a large number of normative legal acts, which indicates the massiveness of housing legislation, judicial practice is not uniform and contradictory. The solution of the above problems is possible by ordering and systematizing the rules governing legal relations on the creation and operation of management organizations, as well as preparing a review of judicial practice on these issues. The practical significance of this study is that the identified problems and their solutions will help to form a uniform application of the current legislation and eliminate the ambiguity of interpretation of the norms.
