The relevance of the topic of this study is expressed in the absence of a single, generally recognized doctrinal and practical approach to understanding and applying the design of an escrow agreement. In this paper, we have identified the problems of the lack of a uniform approach to understanding the design of the escrow agreement, which do not allow us to realize the practical potential of such a design. In order to solve the existing problems, we eliminate problematic issues of this design, related to both the doctrinal aspect and the practical one. The methodological basis of this research is: the universal method of dialectical materialism; General scientific methods of knowledge, expressed in the application of methods of analysis, synthesis, generalization, comparison, classification; special methods inherent in legal science: comparative-legal, formal-dogmatic. The results of the study were sufficiently justified for their perception by representatives of the doctrine of law and representatives of the legislative branch of government. The scope of implementation of the research results: the doctrine of law, lawmaking. The work reveals the essence of the escrow agreement as a new civil legal structure, eliminating the existing doctrinal and practical problems.
