Legal Problems of the Formation and Distribution of Competitive Mass in Bankruptcy

Currently, there is a tendency to increase the number of insolvency cases. At the same time, the amount of satisfied claims of creditors falls. The reasons for this result are: the wrong choice of the method of disposing of property; legislative gaps; misinterpretation and exercise of their rights by participants in a bankruptcy case. The solution to this problem may be the use of other methods of selling property; the use of more practical approaches to inventory, the formation of the bankruptcy estate and the compilation of lots; presentation by the participants of a bankruptcy case of the nuances of satisfying creditors' claims; knowledge of the features of disposal of the debtor's illiquid property. As a result of the study, the connection between the formation of the bankruptcy estate with the full satisfaction of creditors' requirements was proved, the effectiveness of using the direct contract design for the sale of low-value property was proved, an attempt was made to justify the composition of the third-stage registry creditors and the conclusion was made about the actual presence of the fourth stage of creditors, the existence of problems in the field was proved disposal of illiquid property.
