Responsibility of the Sole Executive Body for the Losses Caused to an Economic Company

This graduate work is devoted to the identification of problematic issues of bringing the sole executive body to responsibility for losses caused to the company. The relevance of the study is to maintain a large number of claims by members of companies to recover losses from the director with a significant percentage of refusal of such claims. The work defines the concept and distinctive characteristics of civil liability, the grounds and problematic issues of recovery of losses in general as measures of civil liability and liability of the sole executive body in particular, revealed trends in the development of arbitration court practice on problematic issues of recovery of losses from the director of the company. In the analysis of judicial practice, it was found that the courts were gradually changing the position «in favour» of plaintiffs claiming damages from sole executive bodies.
