Extrajudicial Methods of Resolving Civil Disputes

Currently, there is a tendency towards the development and widespread implementation of out-of-court dispute resolution in the Russian legal system. According to the author of this work, arbitration and mediation are the most effective ways of out-of-court settlement of disputes and deserve special attention because they have several advantages over court proceedings and other methods of alternative dispute resolution. Since at present many issues related to the out-of-court settlement of disputes are unresolved, there is a need for a fundamental study of the topic under discussion. The scientific novelty of the study in question is due to the fact that the work is a comprehensive analysis of the legal regulation of the arbitration proceedings and mediation procedures. This graduation paper proposes solutions to existing theoretical and practical problems associated with the use of arbitration and mediation in Russia. The results of the study can be used to practice the application of arbitration and mediation procedures.
